1.1 The CAFAM computer program is copyrighted and wholly
owned by Zenner Ltd with all rights reserved. Only you, as Original Purchaser,
may use the CAFAM computer program and only on your own computer or network
system.
1.2 Zenner Ltd warrants that as owners of the Copyright of
the CAFAM Computer Program you as the Original Purchaser in paying the agreed
licensing fees may use the CAFAM Computer Program freely without any hindrance
from any person whatsoever.
1.3 Use of the CAFAM program purchased hereby by any other
entity or on a computer system other than the one for which it is being
purchased is an unauthorised use.
1.4 As an Original Purchaser of CAFAM you are licensed only
to use the program from its medium into the memory of a computer solely for the
purpose of executing the program.
1.5 Except for the limited purpose of system back-up,
copying, duplicating, selling or otherwise distributing CAFAM is a violation of
the copyright laws.
1.6 By accepting this agreement, you do not become the owner
of the Software but you do have the right to use the Software in accordance with
the agreement.
2.1 CAFAM is licensed on an "As Is" basis. There
are no warranties expressed or implied, including but not limited to implied
warranties of merchantability of fitness for a particular purpose and all such
warranties are expressly and specifically disclaimed.
2.2 Whilst reasonable steps have been taken in the design of
the Software and the Manual to ensure accuracy, Zenner Ltd or its Agents assumes
no liability resulting from any inaccuracy or omission in this software or
manual, or from the use of the information contained herein.
2.3 Zenner Ltd or its Agents shall have no liability or
responsibility to you or any other person or entity with respect to liability,
loss or damage caused or alleged to be caused directly or indirectly by CAFAM
Software or the User Manual, including but not limited to any interruption of
service, loss of business or anticipatory profits or consequential damage
resulting from the use or operation of the program.
2.4 Good Data processing procedure dictates that the user
test the program, run and test sample sets of data and run the system in
parallel with the system previously in use for a sufficient period of time to
ensure that results of operation of the programs are satisfactory.
3.1 In the course of installing and maintaining the Software,
Zenner Ltd or its Agents undertakes not to divulge to any party information or
data regarding the Original Purchaser which could be used to the detriment of
the Original Purchaser.
3.2 In the course of using the Software, any amendment,
modification, enhancement or update that is made to the Program at the request
or suggestion of the Original Purchaser or Zenner Ltd shall constitute as a
substitute to the originally supplied version and accordingly all of the
conditions of this Licensing Agreement shall apply to the Substitute.
